Terms of Service

These terms govern your access to and use of FixMyAC ("getfixmyac.com"). Please read them carefully before using the platform.

Acceptance of terms

Agreement to terms

By accessing or using the FixMyAC platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the platform. These terms apply to all users, including clients requesting services and technicians providing services.

Changes to terms

We reserve the right to modify these terms at any time. We will notify registered users of material changes by email or through the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

Use of the platform

Eligibility

You must be at least 18 years old and legally able to enter into contracts to use this platform. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the email below if you suspect unauthorized access. We are not liable for any loss arising from unauthorized use of your account.

Prohibited conduct

You may not use the platform for any unlawful purpose, to harass or harm other users, to submit false or misleading information, to reverse-engineer or attempt to extract source code, or to interfere with the platform's operations. Violations may result in immediate account termination.

Services and payments

Service requests

Clients may submit service requests describing their HVAC issue. Acceptance by a technician creates a service agreement between the client and the technician. We facilitate the connection and payment but are not a party to the service agreement.

Pricing and fees

FixMyAC displays estimated pricing ranges based on job type and local market data. Final pricing is agreed upon between the client and technician before work begins. We collect a platform service fee on each completed transaction, which is disclosed at the time of booking.

Payment processing

Payments are processed through our third-party payment provider. By submitting payment information, you authorize us to charge the agreed amount upon service completion. Disputes regarding charges must be submitted within 30 days of the transaction.

Refunds and cancellations

Cancellations made more than 2 hours before the scheduled appointment are eligible for a full refund. Cancellations within 2 hours may incur a cancellation fee. Refund requests for unsatisfactory work must be submitted through our support team within 48 hours of service completion.

Technician terms

Independent contractor status

Technicians using FixMyAC are independent contractors, not employees, agents, or partners of the platform. You are responsible for your own taxes, insurance, licensing, and compliance with applicable laws and regulations in your jurisdiction.

Licensing and certifications

Technicians must hold all licenses, certifications, and permits required by applicable law to perform HVAC work in their service area. You represent and warrant that your credentials are current, valid, and accurately represented in your profile. We may verify credentials periodically and suspend accounts that do not comply.

Work quality

Technicians agree to perform all work in a professional and workmanlike manner consistent with industry standards. You are responsible for obtaining any necessary permits and for the quality of parts and labor provided. Repeat quality complaints may result in account suspension.

Intellectual property

Our content

All content on the FixMyAC platform, including text, graphics, logos, and software, is owned by or licensed to us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Your content

By submitting content to the platform (such as reviews, photos, or messages), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content in connection with operating and improving the platform. You retain ownership of your content.

Disclaimers and liability

Platform disclaimer

FixMyAC is a marketplace that connects clients with independent technicians. We do not guarantee the availability, quality, timeliness, or safety of services. The platform is provided "as is" and "as available" without warranties of any kind, express or implied.

Limitation of liability

To the maximum extent permitted by applicable law, FixMyAC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services obtained through it, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless FixMyAC and its affiliates from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.

Dispute resolution

Between users

Disputes between clients and technicians should first be reported to our support team. We may attempt to mediate but are not obligated to do so. Our decisions regarding platform access and account standing are final.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action arising from these terms must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

Arbitration

For any dispute you have with us that cannot be resolved informally, you agree to binding individual arbitration administered under the rules of the American Arbitration Association. Class actions and class arbitrations are not permitted.

Termination

By you

You may close your account at any time by contacting our support team. Termination does not relieve you of obligations incurred prior to termination, including unpaid fees or outstanding service agreements.

By us

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or conduct that we determine is harmful to other users or the platform. We will provide notice where reasonably practicable.
